Warranty

1. Scope of This Limited Warranty

This Limited Product Warranty applies to DECCO-branded products purchased on or after the Effective Date shown above from DECCO or an authorized DECCO distributor or dealer.

It applies to the original purchaser of the Product and, to the extent permitted by applicable law, is not transferable. Products purchased before the Effective Date are governed by the written warranty in effect on the original date of purchase.

Certain DECCO products may be accompanied by additional product-specific warranty terms. If a product-specific warranty expressly provides greater coverage, that additional coverage will apply only to the product identified in that warranty.

This warranty covers the DECCO Product as supplied. It does not constitute a warranty for installation services, contractor workmanship, the substrate, the underlying structure, waterproofing assemblies, or the complete installed system.

2. Limited Manufacturing Warranty

Subject to all terms, conditions, exclusions, and limitations in this Policy, DECCO warrants to the original purchaser that, for twelve (12) months from the original date of purchase and provided the Product is used before its stated shelf-life expiration, the Product as supplied will:

1. Materially conform to DECCO's published manufacturing specifications in effect on the date of manufacture; and
2. Be free from manufacturing defects that existed when the Product left DECCO's control.

This is a limited warranty covering manufacturing defects in the Product itself. It is not a guarantee of installation quality, project performance, structural performance, waterproofing performance, or any particular decorative or aesthetic result.

Proof of the original purchase date is required. If acceptable proof of purchase is unavailable, DECCO may, where permitted by law, determine the applicable date from the Product's batch, lot, or manufacturing records.

3. Conditions of Warranty Coverage

Warranty coverage applies only when the Product has been:

1. Properly transported and stored in unopened, undamaged packaging and within the temperature, humidity, and shelf-life requirements stated by DECCO;
2. Inspected before use and found free of visible damage, contamination, freezing, separation, incorrect labeling, or other apparent nonconformity;
3. Mixed, diluted, pigmented, combined, and prepared strictly in accordance with the applicable DECCO Product Data Sheet and written instructions;
4. Applied to a structurally sound, stable, properly prepared, clean, dry, and compatible substrate;
5. Applied within the required material, substrate, and ambient temperature ranges and under suitable humidity and ventilation conditions;
6. Applied at the specified coverage rate, thickness, number of coats, and recoat intervals;
7. Allowed to dry and cure for the required period before traffic, cleaning, water exposure, shower use, wet-room use, covering, or placement into service;
8. Protected during installation and curing from contamination, moisture, water, condensation, freezing, excessive heat, dust, debris, traffic, impact, and other harmful conditions; and
9. Used and maintained in accordance with the current applicable DECCO Product Data Sheet, Safety Data Sheet, maintenance instructions, and recognized industry practices.

The purchaser, designer, contractor, and installer are responsible for determining whether the Product is suitable for the intended use and project conditions. Their responsibilities include evaluating the substrate and structure, identifying existing cracks and joints, conducting appropriate moisture and compatibility testing, preparing a representative mock-up, verifying the desired appearance, and calculating sufficient material for the project, including reasonable waste and application losses.

Published coverage rates are estimates based on application at the specified recommended thickness. They do not include material loss, waste, spillage, material remaining in containers or tools, or other application-related losses.

4. Exclusions

This Limited Warranty does not cover any failure, damage, defect, condition, cost, or loss caused or contributed to by:

A. Installation and Application

• Improper, incomplete, or inadequate substrate preparation;
• Application by unqualified or inexperienced personnel;
• Failure to follow the applicable Product Data Sheet or written instructions;
• Incorrect mixing, ratios, dilution, pigmentation, thickness, coverage, number of coats, application method, tooling, sanding, sealing, or finishing;
• Application of expired, frozen, contaminated, improperly stored, or visibly nonconforming Product;
• Application outside the stated temperature, humidity, ventilation, or environmental limits;
• Failure to observe applicable drying, recoat, cure, traffic, cleaning, or water-exposure times; or
• Premature use of showers, wet rooms, floors, countertops, or other treated surfaces.

B. Substrate, Structure, and Moisture

• Cracks, fissures, control joints, expansion joints, cold joints, or movement joints;
• Substrate movement, structural movement, vibration, deflection, settlement, thermal movement, shrinkage, expansion, or building movement;
• Failure or deterioration of concrete, mortar, plaster, drywall, tile, wood, metal, waterproofing, membranes, adhesives, primers, or other underlying materials;
• Moisture vapor transmission, hydrostatic pressure, negative-side moisture, leaks, seepage, rising damp, condensation, standing water, or inadequate drainage;
• An unstable, contaminated, weak, excessively porous, nonporous, wet, uncured, or incompatible substrate; or
• Failure to conduct or properly evaluate required moisture, adhesion, compatibility, or substrate testing.

DECCO products are not structural repair products unless expressly identified as such in the applicable Product Data Sheet. They are not intended to prevent or permanently bridge cracks or movement originating in the substrate or structure.

C. Third-Party Products and Modifications

• Mixing the Product with unauthorized additives, pigments, water, solvents, chemicals, or other materials;
• Altering the Product or its specified mixing ratio;
• Incompatibility with another manufacturer's product; or
• Damage caused by third-party primers, membranes, coatings, sealers, cleaners, adhesives, maintenance products, or installation materials.

The use of a third-party product does not, by itself, eliminate warranty coverage. However, this warranty does not cover defects or damage caused or contributed to by that third-party product or its incompatibility with the DECCO Product.

D. Use, Maintenance, and External Conditions

• Misuse, abuse, neglect, accident, impact, abrasion, scratching, excessive wear, or inadequate maintenance;
• Exposure to chemicals, solvents, acids, alkalis, oils, grease, salts, dyes, cleaners, disinfectants, or other substances beyond the Product's published resistance;
• Excessive traffic, loads, heat, ultraviolet exposure, immersion, standing water, freeze-thaw conditions, or exterior exposure where the Product is not expressly approved for those conditions;
• Acts of nature, flooding, fire, storms, earthquakes, ground movement, power failures, construction activity, vandalism, or other conditions beyond DECCO's reasonable control; or
• Repairs, alterations, maintenance, or cleaning performed contrary to DECCO's written instructions.

5. Appearance and Decorative Variations

DECCO products include decorative, cementitious, mineral, resinous, and hand-applied finishes. Variations may naturally result from raw materials, pigmentation, substrate conditions, application technique, environmental conditions, lighting, sealing, and curing.

Normal or application-related variations in color, shade, tone, texture, mottling, movement, sheen, trowel marks, aggregate distribution, batch appearance, or finished appearance are not manufacturing defects.

Samples, displays, printed materials, photographs, videos, websites, digital renderings, and color charts are approximate representations only. DECCO does not warrant an exact match to any sample, image, previous installation, or separate production batch.

The purchaser and installer must prepare and approve a representative project mock-up before full installation when appearance is material to the project.

6. Installer Workmanship and Technical Assistance

DECCO does not select, employ, direct, or control independent distributors, dealers, contractors, installers, applicators, architects, engineers, consultants, or other third parties.

DECCO does not warrant:

• Installer or contractor workmanship;
• Compliance of the installation with project specifications, building codes, plans, or applicable regulations;
• The condition or performance of the substrate or underlying structure;
• The performance of products supplied by others;
• The complete installed system; or
• Any specific aesthetic result.

Technical information, training, demonstrations, calculations, recommendations, site visits, communications, or assistance provided by DECCO are for informational purposes only. They do not constitute supervision or acceptance of the work, approval of the substrate or installation, architectural or engineering services, a determination of the cause of a failure, or an additional warranty.

No technical statement changes this Policy unless contained in a written warranty amendment signed by an authorized officer of DECCO.

7. Inspection Before Installation

The purchaser and installer must inspect the Product, packaging, labels, color, batch information, and condition before mixing or application.

Do not use Product that appears damaged, frozen, contaminated, separated beyond restoration, expired, incorrectly labeled, or otherwise nonconforming. Do not continue installation after discovering a suspected Product problem.

Use or installation of Product with an apparent defect may affect coverage to the extent that continued use causes additional damage or prevents DECCO from reasonably evaluating the original condition.

8. How to Submit a Warranty Claim

A warranty claim must be submitted in writing:

1. Within thirty (30) days after the alleged defect is discovered or reasonably should have been discovered;
2. Within the applicable twelve-month warranty period; and
3. Before removal, demolition, repair, replacement, refinishing, or material alteration of the affected area, except for emergency measures reasonably necessary to prevent additional damage or protect health and safety.

These notice periods apply to the extent permitted by applicable law. A delay will not bar a claim where prohibited by law, but may affect coverage to the extent the delay materially prevents DECCO from inspecting, testing, or determining the cause of the condition.

The claim should include:

• Purchaser's name and contact information;
• Proof of purchase and purchase date;
• Product name, color, package size, and quantity;
• Batch and lot numbers;
• Distributor or dealer information;
• Project address and type of application;
• Installer's name and contact information;
• Installation, coating, and service dates;
• Substrate description and preparation records;
• Moisture, adhesion, compatibility, and environmental test results;
• Mixing and application records;
• Photographs and videos showing the overall area and alleged defect;
• A description of the condition and when it was first observed;
• Maintenance, cleaning, and repair records; and
• Any unopened or unused Product, packaging, labels, and samples that remain available.

Failure to provide a particular document will not automatically invalidate a claim where prohibited by law. However, DECCO may request information reasonably necessary to verify coverage and determine the cause of the reported condition.

9. Inspection, Testing, and Preservation of Evidence

DECCO must be given a reasonable opportunity to inspect and test the Product, substrate, installation, and affected area before removal or repair.

The purchaser must take reasonable steps to preserve relevant evidence, including remaining Product, packaging, batch labels, photographs, installation records, and representative samples.

Except for emergency measures necessary to prevent additional damage or protect health and safety, do not remove, cover, repair, or alter the affected area before DECCO has had a reasonable opportunity to inspect.

DECCO may inspect the site, request samples, perform testing, review project documents, consult technical specialists, or obtain an independent evaluation. An inspection or investigation does not constitute an admission of defect, coverage, responsibility, or liability.

10. Exclusive Limited Remedy

If DECCO determines that the Product contained a manufacturing defect covered by this Limited Warranty, DECCO's sole and exclusive obligation, at its option and to the fullest extent permitted by law, will be to:

1. Replace the quantity of Product proven to be defective; or
2. Refund the purchase price actually paid for that quantity of defective Product.

If the original Product is unavailable, DECCO may provide a reasonably comparable replacement product or issue the applicable refund.

Replacement Product is warranted only for the remainder of the original warranty period. Replacement does not restart or extend the original warranty period.

This Limited Warranty does not cover labor, contractor charges, testing, inspection expenses incurred by the claimant, surface preparation, protection, access, demolition, removal, disposal, transportation, shipping, equipment, scaffolding, temporary facilities, loss of use, project delays, alternative accommodations, installation, refinishing, or reinstallation.

No payment, replacement, inspection, settlement, or other action taken by DECCO regarding one claim constitutes an admission of liability or creates coverage for any other claim.

11. Limitation of Liability

These limitations do not apply to liability that cannot lawfully be excluded or limited. Some jurisdictions do not permit certain exclusions or limitations, so some of the foregoing provisions may not apply.

12. Commercial and Non-Consumer Transactions

13. Consumer Rights

For consumer transactions, implied warranties are not disclaimed where such disclaimer is prohibited by applicable law. Where legally permitted, the duration of any applicable implied warranty is limited to the twelve (12)-month duration of this Limited Warranty.

Some states or jurisdictions do not allow limitations on the duration of implied warranties or the exclusion or limitation of incidental or consequential damages. Accordingly, some limitations or exclusions in this Policy may not apply.

This Limited Warranty gives consumers specific legal rights. Consumers may also have other rights that vary by state, province, country, or jurisdiction.

Nothing in this Policy excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified.

14. No Unauthorized Modification

No distributor, dealer, installer, applicator, contractor, sales representative, employee, or other person is authorized to modify this Limited Warranty, extend its duration, expand its remedies, or make an additional warranty or representation on behalf of DECCO.

Any modification must be contained in a written document that specifically identifies the Product and is signed by an authorized officer of the legal entity issuing this warranty.

15. Relationship to Product Documents

The applicable DECCO Product Data Sheet contains product-specific technical requirements, limitations, coverage rates, application conditions, drying times, cure times, maintenance instructions, and safety references.

The Product Data Sheet and this Policy should be read together. The Product Data Sheet controls product-specific technical requirements. This Policy controls warranty coverage, exclusions, claim procedures, remedies, and limitations.

If a translated version differs from the English version, the English version will control, except where applicable law requires otherwise. Mandatory rights under applicable local law remain unaffected.

16. Policy Changes and Applicable Version

DECCO may revise this Policy prospectively. The version in effect on the original date of purchase will apply to that purchase unless applicable law requires otherwise.

The Effective Date and version number must appear on each published version. Material changes will not retroactively reduce warranty coverage for Products purchased before the revised policy's effective date.

17. Severability and No Waiver

If any provision of this Policy is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

DECCO's failure to enforce a provision in a particular instance does not waive its right to enforce that provision or any other provision in the future.

18. Obtaining a Copy or Contacting DECCO

A free copy of this Limited Warranty is available before purchase and upon request.
